My Plannery, Inc. ("Plannery," "we," "us," "our") provides its services to you through its website located at [www.myplannery.com] (the "Site") and related applications and services (collectively, the "Service(s)"). These Terms of Service (the "Terms") govern your use of the Services. By accessing or using the Services, you agree to comply with and be bound by these Terms. If you do not agree, you may not use the Services.

We may update our policies relating to payments, fees, or dispute resolution in response to changes in law, card network rules, or processor requirements, and such updates will be effective immediately upon posting.

My Plannery Terms of Service

  1. Acceptance of Terms
    1. By accessing or using My Plannery’s Services, you agree to these Terms, including any additional terms and policies referenced herein. My Plannery reserves the right to update these Terms at any time. Changes will be posted on the Site, and we may notify users via email or a platform notification at least 30 days in advance.
  2. Description of Services
    1. My Plannery offers tools for event planning and business management, including booking, invoicing, client management, and payment processing. Additional features may be added or removed at our discretion.
    2. My Plannery does not act as your agent, fiduciary, or escrow provider in connection with payment services. All payment transactions are solely between you and your customers.
  3. User Eligibility
    1. The Services are available to users aged 18 and older. By using the Services, you confirm you meet this requirement. If you are under 18 but at least 16, your parent or legal guardian must agree to these Terms on your behalf, and they are responsible for your use of the Services.
  4. Registration and Account Security
    1. To access certain features, you must register an account. You agree to provide accurate and current information and maintain the confidentiality of your login credentials. You are responsible for all activities under your account.
    2. You agree not to impersonate others, create accounts for fraudulent purposes, or use the Services for illegal activity. My Plannery reserves the right to suspend or terminate accounts suspected of fraud, money laundering, or violations of card network or NACHA rules.
  5. Fees and Payment
    1. Subscription Plans: My Plannery offers subscription-based access to premium features. Details on pricing will be outlined on the Site. Annual subscription plans may offer a discount compared to monthly plans, and users can switch between plans under specific conditions outlined on the Site. Switching plans may result in prorated charges. Refunds for unused portions of subscriptions will be issued only in cases where mandated by law or explicitly outlined in our refund policy.
    2. Transaction Fees: My Plannery charges a percentage fee for transactions processed through the platform. Specific rates will be detailed during onboarding or available on our website.
    3. Optional Features and Non-Refundable Fees: Certain features within the Services (such as Account Updater, instant payouts, or similar enhancements) are optional and may be enabled or disabled by you. Enabling such features may incur additional usage-based fees as outlined on our Site or during onboarding. Fees associated with use of these features are non-refundable, including where you later disable the feature after it has been used. You are solely responsible for reviewing and managing feature activations within your account.
    4. Promotional Discounts: My Plannery may offer promotional discounts through promo codes or special offers at events or conferences. Promo codes must be redeemed at the time of purchase and are subject to expiration dates and other restrictions. Promotional offers cannot be combined with other discounts unless explicitly stated.
    5. Refund Policy: Users may request refunds in accordance with My Plannery’s refund policy, which will be made available on the Site.
    6. Disputes, Chargebacks, and Returns: You are solely responsible for all refunds, disputes, chargebacks, ACH returns, and network fines arising from your customers’ use of the Services. My Plannery may deduct related amounts (including any dispute or return fees) from your payouts or invoice you directly.
    7. Right to Withhold/Offset: My Plannery reserves the right to withhold payouts or offset any amounts owed against fees, chargebacks, disputes, refunds, penalties, or other liabilities associated with your use of the Services.
  6. 14-Day Free Trial
    1. My Plannery offers a 14-day free trial available only to new customers and is limited to one per account. The trial includes access to full features of all available features. At the end of the trial period, you will be required to select a subscription package to continue having access to your account.
    2. Automatic Billing Post-Trial: Users agree to be automatically billed (monthly or at renewal period for annual paid plans) for the selected subscription tier at the end of the trial period unless they cancel in advance. Cancellation can be done through the account settings or by contacting support.
    3. Cancellation Policy: If the subscription is canceled during the trial period, no charges will be applied. If canceled after the trial ends, charges for the ongoing subscription period will not be refunded.
  7. User Content
    1. You retain ownership of any content you upload to the Services. By uploading, you grant My Plannery a license to use the content solely for operating and improving the Services. Aggregated and anonymized data may include information about how users interact with the Services but will not include any personally identifiable information without explicit user consent.
    2. You represent and warrant that any content or data you upload does not infringe on the rights of third parties or violate applicable law. My Plannery may use aggregated, anonymized data to improve its fraud prevention, compliance, and risk management processes.
  8. Payment Processing
    1. My Plannery partners with Finix for payment processing. By using our Services, you agree to Finix’s terms and conditions, as well as all applicable card network and NACHA rules. You acknowledge that Plannery does not control payment processors, banks, or networks and is not responsible for delays, errors, or losses caused by them. You are solely responsible for ensuring you have authorization from your customers for all transactions.
    2. ACH Authorization: By providing and saving your bank account information, you authorize My Plannery, Inc. to debit your account for your subscription fees and any other payments you authorize, whether one-time or recurring. You also authorize credits to your account for refunds or error corrections, and reinitiation of debits if a payment is returned (e.g., insufficient funds). This authorization remains in effect until you revoke it by removing your bank account in Plannery or contacting Plannery support. 
      1. By paying an invoice through Plannery, your customer authorizes My Plannery, Inc. to debit their bank account or charge their card on behalf of you, the merchant, for one-time or recurring payments. You are responsible for providing accurate customer information and refunding any transactions that are invalid or disputed.
    3. Surcharging (Processing Fee) Compliance: If you choose to pass processing fees on to your customers (“surcharging”), you are responsible for ensuring compliance with all applicable laws, state restrictions, and card network rules. Surcharges may only be applied to credit cards (not debit or prepaid), and the surcharge amount cannot exceed your actual cost of acceptance or the network cap (up to 4% depending on the network). Card networks require advance registration and approval before surcharging is permitted, and there is a mandatory 30-day waiting period after registration before you may begin surcharging. Registration is generally submitted through your payment processor and may in some cases be handled on your behalf, but you remain responsible for ensuring that registration is properly completed. You must also provide clear disclosure of any surcharge to customers both at checkout and on receipts, and confirm that surcharging is permitted in the jurisdictions where you operate. Plannery provides tools to facilitate surcharging but does not monitor or guarantee compliance, and you remain solely responsible for the lawful use of these features.
    4. Card Type Acceptance and Unknown Cards: Merchants may elect to enable or disable acceptance of certain card types (e.g., credit vs. debit). However, if a transaction is received with a card type classified as “unknown” by the payment network or processor, Plannery will process the transaction regardless of the merchant’s selected preferences. In such cases, if the merchant has enabled processing fee pass-through, no processing fee will be applied to the transaction in order to ensure debit cards are not inadvertently surcharged. Plannery disclaims responsibility for transactions misclassified by networks or processors.
  9. Third Party Integration
    1. Plannery may integrate with or provide access to products and services offered by third-party providers to enhance its platform's functionality. Plannery does not own, control, or directly manage the code or operations of these third-party services and, therefore, disclaims all liability for any bugs, errors, outages, or downtime associated with their use.
    2. While Plannery endeavors to collaborate with these third-party providers to address and resolve any issues impacting its customers, it makes no guarantees regarding the timeliness or success of such resolutions. Customers acknowledge and accept that the availability and performance of third-party integrations are subject to the terms and conditions of the respective providers.
    3. By using the Services, you agree to comply with the terms and conditions of third-party providers. Plannery is not responsible for the performance or compliance of third-party services.
  10. Privacy Policy
    1. Your use of the Services is subject to our Privacy Policy, which you must review and accept as part of these Terms. The Privacy Policy explains how we collect, use, and protect your data.
  11. Intellectual Property
    1. My Plannery retains all rights to its proprietary software and trademarks. Users may not copy, distribute, or create derivative works from the Services without prior authorization. Violations of intellectual property rights may result in suspension or termination of your account and potential legal action.
    2. You may not reverse engineer, decompile, or misuse Plannery’s software. Any feedback you provide may be used without obligation to you.
  12. Termination
    1. My Plannery may suspend or terminate your account for violations of these Terms or prolonged inactivity. 
    2. Prolonged inactivity is defined as 12 months of no logins or activity. Upon termination, your data will be deleted and cannot be recovered unless required by applicable laws.
    3. Termination will not relieve you of any outstanding payment obligations, dispute liabilities, or compliance requirements, including refunds, chargebacks, or regulatory requests.
  13. Limitation of Liability
    1. To the maximum extent permitted by law, My Plannery, Inc. is not liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to lost profits, lost data, business interruption, unauthorized access, or fraudulent activity by third parties, arising from or related to your use of the Services. In no event shall My Plannery’s total liability for any claim exceed the total fees you paid to My Plannery in the three (3) months preceding the event giving rise to the claim.
    2. Some jurisdictions do not allow the exclusion or limitation of certain damages. In such cases, our liability will be limited to the maximum extent permitted by applicable law.
  14. Indemnification
    1. You agree to indemnify and hold harmless My Plannery, Inc., its affiliates, officers, employees, and partners from any claims, damages, losses, liabilities, or expenses (including legal fees) arising out of (a) your use of the Services, (b) your customers’ use of the Services, (c) your breach of these Terms, or (d) any disputes, refunds, chargebacks, surcharges, or penalties related to transactions you process through the Services.
  15. Disclaimer of Warranties
    1. The Services are provided “as is” and “as available.” My Plannery makes no warranties, express or implied, regarding uptime, security, availability, or fitness for a particular purpose. We do not guarantee uninterrupted or error-free operation of the Services.
  16. Arbitration Agreement
    1. All disputes will be resolved through binding arbitration under the rules of the American Arbitration Association. This agreement waives your right to a jury trial or to participate in class actions.
    2. You may opt out of this arbitration agreement by sending a written notice to hello@myplannery.com within 30 days of agreeing to these Terms.
  17. Governing Law
    1. These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles. Disputes will be resolved under the laws of this jurisdiction.

  • Merchants: If you make a payment through Plannery, we share your payment details with the relevant merchant so they can process and reconcile your transaction.

  • Professional Advisors: Legal, financial, and compliance consultants.
  • Authorities: To comply with legal obligations or respond to lawful requests.

5. Security

No method of transmission over the Internet is completely secure, and you are responsible for keeping your account credentials safe. If you believe your account has been compromised, contact us immediately.

6. Data Retention

We retain personal information for as long as necessary to provide our Services, comply with legal obligations, resolve disputes, and enforce our agreements. Certain payment and transaction data may be retained longer as required by law, card network rules, or regulatory obligations. Marketing data will be retained for 7 years unless you opt out.

7. Children's Privacy

Plannery does not knowingly collect information from individuals under the age of 13 and complies with the Children’s Online Privacy Protection Act (COPPA). If we learn that we have collected such information, we will delete it promptly. If you believe we have collected data from a child under 13, please contact us.

8. International Users

If you access our Services outside the United States, your information may be transferred to and processed in the United States or other countries with different data protection laws. Where required, we use appropriate safeguards such as Standard Contractual Clauses (SCCs).

9. Changes to This Policy

If we make significant changes to this policy, we will notify you by email or post an update on our website at least 30 days before the changes take effect.
