Welcome to My Plannery!
My Plannery, Inc. ("MyPlannery", "Plannery," "we," "us," "our") provides its services to you through its website located at [www.myplannery.com] (the "Site") and related applications and services (collectively, the "Service(s)"). These Terms of Service (the "Terms") govern your use of the Services. By accessing or using the Services, you agree to comply with and be bound by these Terms. If you do not agree, you may not use the Services.
These Terms contain a binding arbitration agreement and a class action waiver in the Arbitration Agreement section, a limitation of MyPlannery’s liability in the Limitation of Liability section, and a disclaimer of warranties in the Disclaimer of Warranties section. Please read those sections carefully. They affect your legal rights.
We may update our policies relating to payments, fees, pricing, compliance requirements, or dispute resolution in response to changes in law, card network rules, NACHA rules, banking partner requirements, or processor requirements, and such updates will be effective immediately upon posting unless otherwise stated.
By accessing or using MyPlannery’s Services, you agree to these Terms, including any additional terms and policies referenced herein. MyPlannery reserves the right to update these Terms at any time. Changes will be posted on the Site, and we may notify users via email or a platform notification at least 30 days in advance when required by law. MyPlannery will update the "Last Updated" date when these Terms change. Your continued access to or use of the Services after an update takes effect constitutes your acceptance of the updated Terms. If you do not agree to an update, you must stop using the Services and close your account before the update takes effect. Updates apply prospectively and do not affect any dispute that arose before the update took effect.
Certain features of the Services, including the IQ Features described in the MyPlannery IQ Suite section, may be subject to additional terms presented when you enable or use them (’Feature Terms’). Feature Terms are part of these Terms. If Feature Terms conflict with these Terms, the Feature Terms control for that feature. MyPlannery may record the date, time, and version of any Feature Terms you accept, and where the Feature Terms so provide, the version you accepted governs that activation.
MyPlannery offers tools for event planning and business management, including booking, invoicing, client management, payment processing, reporting, compliance tools, automation and artificial intelligence features, and related operational features. Additional features may be added, modified, or removed at our discretion.
The Services include the MyPlannery IQ Suite, a set of optional features described in the MyPlannery IQ Suite section of these Terms.
MyPlannery does not act as your agent, fiduciary, financial advisor, or escrow provider in connection with payment services. All payment transactions are solely between you and your customers.
MyPlannery is a software provider. MyPlannery is not a bank, money transmitter, lender, payment processor, tax preparer, accountant, law firm, or insurer, and does not provide legal, tax, accounting, financial, or compliance advice. Nothing in the Services constitutes professional advice, and you are responsible for obtaining your own professional advice.
The Services are available only to individuals who are at least 18 years old and who have the legal capacity to enter into a binding contract. By using the Services, you represent that you meet these requirements. The Services are not available to individuals under 18, and MyPlannery may suspend or terminate any account it believes is held or used by a person under 18.
The Services are intended for business use. By using the Services, you represent and warrant that you are using them for business or commercial purposes and not as a consumer for personal, family, or household purposes, and that you are acting on behalf of a business you own or are authorized to bind. If you accept these Terms on behalf of an entity, you represent that you have authority to bind that entity, and "you" refers to that entity.
You further represent and warrant that you and your business are not, and are not owned or controlled by a person or entity that is, identified on any U.S. government list of restricted or prohibited parties, including the U.S. Treasury Department’s Specially Designated Nationals and Blocked Persons List, and that you are not located in, organized under the laws of, or ordinarily resident in any country or region subject to comprehensive U.S. sanctions. You will not use the Services in violation of any applicable export control, sanctions, or anti-money laundering law.
To access certain features, you must register an account. You agree to provide accurate, current, and complete information and to maintain the confidentiality of your login credentials. You are responsible for all activities under your account.
You agree not to impersonate others, create accounts for fraudulent purposes, or use the Services for illegal activity. MyPlannery reserves the right to suspend or terminate accounts suspected of fraud, money laundering, regulatory violations, or violations of card network, NACHA, or processor rules.
You are responsible for the acts and omissions of your team members, authorized users, contractors, and anyone else who accesses the Services through your account, including through credentials, API keys, tokens, or integrations you create or authorize. You will notify MyPlannery promptly at hello@myplannery.com if you learn of any unauthorized access to or use of your account.
In addition to the restrictions elsewhere in these Terms, you agree not to, and not to permit any third party to:
MyPlannery may investigate suspected violations and may suspend or restrict access, with or without prior notice, where MyPlannery reasonably believes a violation has occurred or is necessary to protect the Services, other users, or third parties.
MyPlannery offers subscription-based access to premium features. Details on pricing will be outlined on the Site. Annual subscription plans may offer a discount compared to monthly plans, and users can switch between plans under specific conditions outlined on the Site. Switching plans may result in prorated charges. Refunds for unused portions of subscriptions will be issued only in cases where mandated by law or explicitly outlined in our refund policy.
Once you activate a paid plan, it renews automatically at the end of each billing period, monthly or annually as selected, at the then-current rate, until you cancel. You authorize MyPlannery to charge your payment method on file for each renewal. You may cancel at any time in your account settings or by contacting hello@myplannery.com, and cancellation takes effect at the end of the then-current billing period. MyPlannery may change subscription pricing on at least 30 days’ notice, and the new pricing applies at your next renewal after the notice period.
All fees are exclusive of taxes. You are responsible for all sales, use, value added, gross receipts, and similar taxes, duties, and assessments imposed on the fees, other than taxes based on MyPlannery’s net income. If MyPlannery is required to collect any such tax, MyPlannery may add it to your invoice or charge it to your payment method on file.
MyPlannery charges transaction-based fees for payments processed through the platform. Specific rates will be disclosed during onboarding, in pricing materials, or on our website. If you enable PrecisionIQ on an invoice, the PrecisionIQ Fee also applies to payments on that invoice, as described in the PrecisionIQ section of these Terms.
Certain features within the Services, including but not limited to PrecisionIQ and other IQ Features, automated communications, artificial intelligence features, Account Updater, instant payouts, compliance tools, reporting features, tax document services, and similar enhancements, may be optional and may incur additional usage-based fees. Enabling such features may result in charges as outlined on our Site or during onboarding.
Fees associated with the use of optional features are non-refundable, including where you later disable the feature after it has been used. You are responsible for reviewing and managing feature activations within your account.
MyPlannery may offer promotional discounts through promo codes or special offers. Promo codes must be redeemed at the time of purchase and are subject to expiration dates and restrictions. Promotional offers cannot be combined unless explicitly stated.
Users may request refunds in accordance with MyPlannery’s refund policy, which will be made available on the Site. Except where a refund is required by applicable law or expressly provided in a written refund policy MyPlannery publishes on the Site, all fees are non-refundable.
Amounts not paid when due may accrue interest at the lesser of 1.5% per month or the maximum rate permitted by law, calculated from the due date until paid. You are responsible for reasonable costs of collection, including collection agency fees and reasonable attorneys’ fees, to the extent permitted by law.
You are solely responsible for all refunds, disputes, chargebacks, ACH returns, reversals, penalties, and network fines arising from your customers’ use of the Services.
Refunds, reversals, chargebacks, disputes, ACH returns, or other transaction adjustments do not result in the return or credit of processing fees, PrecisionIQ Fees, IQ Feature fees, compliance platform fees, usage-based fees, or any other platform fees, all of which are non-refundable once a transaction is processed.
For invoices on which PrecisionIQ is enabled, refunds are calculated as described in the PrecisionIQ section of these Terms.
You acknowledge and agree that certain fees, costs, assessments, penalties, taxes, filing charges, reporting charges, processor-imposed charges, compliance costs, documentation costs, mailing costs, and other amounts may be imposed on MyPlannery by payment processors, sponsor banks, financial institutions, card networks, government agencies, or third-party service providers as a result of your use of the Services, your transactions, your account activity, or regulatory obligations (collectively, ’Recoverable Costs’).
Recoverable Costs include, without limitation:
You expressly authorize MyPlannery to recover all Recoverable Costs from you.
To satisfy any Recoverable Costs, you authorize MyPlannery, without additional notice and to the fullest extent permitted by law, to:
This authorization applies whether costs are incurred directly by MyPlannery or passed through by processors, banks, networks, or third-party service providers.
If sufficient funds are not available at the time a Recoverable Cost is incurred, you agree that MyPlannery may recover such amounts from:
This right continues until all amounts owed are fully satisfied.
If Recoverable Costs exceed available funds, your account may reflect a negative balance. You agree that:
Your authorization for MyPlannery to debit accounts, offset payouts, and recover costs:
Recoverable Costs, disputes, chargebacks, returns, penalties, fines, and other liabilities may be satisfied before funds are released to you.
If Recoverable Costs cannot be recovered through the methods above, MyPlannery may:
You agree to pay all reasonable costs associated with recovery of unpaid amounts where permitted by law.
MyPlannery is not required to advance funds on your behalf or absorb any losses related to your transactions, disputes, compliance obligations, processor-imposed costs, or regulatory requirements.
MyPlannery may offer a 30-day free trial available only to new customers and limited to one per account. The trial may include access to full features. No payment method is required to start a free trial, and no charge is made during the trial or when it ends. A free trial does not convert automatically into a paid subscription. When the trial ends, access to trial features may be reduced or removed unless you activate a paid plan.
You are charged only if and when you choose to activate a paid subscription plan. When you activate a paid plan, you select a plan and billing period, provide a payment method, and authorize MyPlannery to charge that payment method for the initial period and for each renewal period. MyPlannery discloses the rate and billing period before you activate a paid plan.
No charges are applied during a free trial, so there is nothing to cancel to avoid a charge. Once you activate a paid plan, you may cancel at any time in your account settings or by contacting hello@myplannery.com. Cancellation takes effect at the end of the then-current billing period, you retain access through that period, and charges for the ongoing period are not refunded.
MyPlannery may offer one or more subscription plans at no charge, including the Ignite plan. Plans offered at no charge are provided "as is" and without any commitment as to features, capacity, availability, or support. MyPlannery may change, limit, suspend, or discontinue a no-charge plan, or begin charging for it, at any time on reasonable notice, and no refund arises from doing so. Usage-based fees, including payment processing fees, transaction fees, PrecisionIQ Fees where enabled, and Recoverable Costs, apply to activity on every plan, including plans offered at no charge.

To ensure fairness and protect against misuse, users may not repeatedly upgrade and downgrade within short periods to avoid charges or unfairly access premium features. MyPlannery reserves the right to limit plan changes, deny prorated adjustments, or suspend accounts engaging in abusive activity.
You retain ownership of any content you upload. By uploading content, you grant MyPlannery a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify, adapt, transmit, display, and otherwise use that content as necessary to operate, secure, support, and improve the Services and to perform the Services at your direction, including delivering content to recipients you designate. This license is sublicensable only to MyPlannery’s service providers acting on MyPlannery’s behalf, and it ends when you delete the content or close your account, except for copies retained in routine backups, copies retained as required by law, and any content already delivered to a third party at your direction. Aggregated and anonymized data may be used for analytics, fraud prevention, compliance, and service improvement, and to create aggregated benchmarks and insights as described in the Data Used by IQ Features section.
This license includes the right to process your content, Customer Data, and Connected Account data using automated systems and artificial intelligence, including through third-party service providers, to provide IQ Features and to train and improve MyPlannery’s own models, as described in the MyPlannery IQ Suite section.
You represent and warrant that your content does not infringe on third-party rights or violate applicable laws. You are solely responsible for your content, including its accuracy, legality, and your right to submit it, and for maintaining your own copies. MyPlannery does not guarantee the retention, storage, or availability of your content and is not a backup or archival service.
If you provide suggestions, ideas, feature requests, or other feedback about the Services, you grant MyPlannery a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate that feedback into the Services or any other MyPlannery product without restriction, attribution, or compensation. Feedback is provided voluntarily and is not confidential.
MyPlannery partners with Stripe and other payment partners for payment processing. By using the Services, you agree to Stripe’s terms and all applicable card network and NACHA rules. You acknowledge that you are entering into a separate agreement with Stripe, including the Stripe Connected Account Agreement, that MyPlannery is not a party to that agreement, and that Stripe may independently approve, decline, suspend, or terminate your ability to process payments. MyPlannery is not responsible for Stripe’s decisions, holds, reserves, or account actions. PrecisionIQ Fees and other platform fees may be collected at the time of each transaction through our payment processing partners, including by deduction from the transaction amount.
You acknowledge that MyPlannery does not control payment processors, banks, or networks and is not responsible for delays, errors, or losses caused by them.
By providing and saving your bank account information, you authorize MyPlannery, Inc. to debit your account for:
You also authorize credits to your account for refunds or error corrections and reinitiation of debits if a payment is returned. This authorization remains in effect until revoked by removing your bank account or contacting support, provided revocation does not affect amounts already owed.
By paying an invoice through MyPlannery, your customer authorizes MyPlannery to debit their bank account or charge their card on your behalf. You are responsible for providing accurate customer information and refunding invalid or disputed transactions.
To comply with card network, banking, and risk management requirements, MyPlannery and its payment partners may apply transaction and volume limits. Limits may vary based on account age, processing history, verification status, risk profile, and regulatory requirements. MyPlannery reserves the right to modify limits at any time.
Merchants may elect to enable or disable acceptance of certain card types. However, if a transaction is received with a card type classified as unknown by the payment network or processor, MyPlannery will process the transaction regardless of merchant preferences. MyPlannery disclaims responsibility for transactions misclassified by networks or processors.
The Card Price applies to all card payments on invoices on which PrecisionIQ is enabled, regardless of card type, including card types classified as unknown.
The MyPlanneryIQ Suite is a set of features within the Services that use automation, rules and settings you configure, and in some cases artificial intelligence, to help you price your services, manage and qualify inquiries, communicate with customers and prospects, analyze profitability, and grow your business (each, an ’IQ Feature’). IQ Features currently include PrecisionIQ™, InboundIQ™, GrowthIQ™, and MarginIQ™. MyPlannery may add, rename, modify, or discontinue IQ Features at any time.
This section applies to all IQ Features, including IQ Features made available after you accept these Terms. Individual IQ Features are also subject to the feature-specific terms below and to any Feature Terms presented when you enable them. If a feature-specific term conflicts with the general terms in this section, the feature-specific term controls for that feature.
For purposes of these Terms:
Access to IQ Features, and the limits that apply to them, may vary by subscription plan. An IQ Feature may be included in your plan, offered as an add-on, or subject to usage-based fees, which may be measured by transaction, communication, Automated Action, artificial intelligence usage, or another unit disclosed on the Site or within the Services before the fees apply. Fees for IQ Features are subject to the Optional Features and Non-Refundable Fees section of these Terms. MyPlannery may set and change usage limits for IQ Features, including limits on the number and frequency of communications and Automated Actions.
By enabling an IQ Feature, you authorize MyPlannery to perform Automated Actions on your behalf in accordance with your Configurations, including Automated Actions that occur after you enable the feature without further confirmation from you, unless the Services require your approval. Automated Actions are treated as actions taken by you. You are responsible for your Configurations, for the Automated Actions taken under them, and for the acts of any team member or authorized user who configures, approves, or uses an IQ Feature on your account. Your Configurations remain in effect until you change them or disable the IQ Feature.
Performing Automated Actions at your direction does not make MyPlannery your agent, fiduciary, or representative for any other purpose. Unless an IQ Feature expressly provides otherwise and you have enabled that functionality, IQ Features will not accept offers, execute contracts, or make commitments on your behalf to your customers or any third party.
You are responsible for reviewing your Configurations regularly, monitoring the Automated Actions taken on your account, and promptly disabling any IQ Feature that is not operating as you intend. Disabling an IQ Feature stops future Automated Actions but does not reverse Automated Actions already taken or fees already incurred.
MyPlannery may require your explicit approval before certain Automated Actions are taken, including actions that initiate, refund, or reverse payments; send invoices or payment requests; change prices or apply discounts; send, sign, or countersign contracts; delete data; or share Customer Data with third parties other than as described in your Configurations. MyPlannery determines which actions require approval and may change those requirements at any time. Where the Services allow you to pre-approve a category of Automated Actions, you are responsible for all actions taken within that pre-approval.
IQ Features may send emails and, where available, text messages or other communications to your customers, prospects, and other recipients, whether from your Connected Accounts or from MyPlannery’s systems. All such communications are sent on your behalf, and you are the sender and initiator of those communications for purposes of applicable law.
You are solely responsible for the content of communications sent through IQ Features, including templates you create and AI Outputs you use or approve, and for complying with all laws that apply to those communications, including the CAN-SPAM Act, the Telephone Consumer Protection Act, state telemarketing, text messaging, and consumer protection laws, and applicable privacy and anti-spam laws outside the United States. Without limiting the foregoing, you agree to:
MyPlannery may add sender identification, unsubscribe mechanisms, or disclosures to communications sent through the Services, and you will not remove or obscure them. MyPlannery may automatically suppress communications to recipients who have opted out, whose addresses bounce, or who have reported communications as unwanted. MyPlannery does not guarantee that any communication will be delivered, delivered on time, or read, and delivery may be affected by the sending limits and policies of email, messaging, and telecommunications providers.
Certain IQ Features use artificial intelligence, including models provided by third parties. AI Outputs are generated automatically and may be inaccurate, incomplete, outdated, or inappropriate for your circumstances, and similar AI Outputs may be provided to other users. You are responsible for reviewing AI Outputs before relying on them or allowing them to be used in Automated Actions, and for all decisions you make based on them.
AI Outputs, qualification results, pricing calculations, benchmarks, and financial metrics provided by IQ Features are informational tools. They are not legal, tax, accounting, financial, or other professional advice, and they do not replace your own judgment or the advice of qualified professionals.
As between you and MyPlannery, and to the extent permitted by law, you own the AI Outputs generated from your content, and MyPlannery assigns to you any rights it may have in those AI Outputs. This does not grant you any rights in MyPlannery’s software, models, prompts, templates, or other intellectual property.
When you link a Connected Account, you authorize MyPlannery to access, retrieve, store, and act on data in that account to the extent necessary to provide the IQ Features you enable, which may include reading and sending email, checking calendar availability, creating calendar entries, and syncing accounting records. You represent that you are authorized to grant this access. You may revoke access at any time through the Services or through the third-party provider, which will disable IQ Features that depend on that access.
Your use of a Connected Account remains subject to the third-party provider’s terms and policies. MyPlannery does not control third-party providers and is not responsible for their availability, sending limits, security, changes to their products or interfaces, or any restriction or suspension of your Connected Account by the provider.
MyPlannery’s use and transfer of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements. Notwithstanding anything else in these Terms, MyPlannery does not use information received from Google APIs to develop, improve, or train any artificial intelligence or machine learning model other than a model tailored exclusively to your account, and does not include that information in aggregated insights that MyPlannery publishes or shares outside the Services.
MyPlannery may allow you to connect an AI Integration to the Services so that you can query your own account information from a third-party assistant or application you control. Connecting an AI Integration is optional and is entirely your decision.
When you enable an AI Integration, you authorize MyPlannery to transmit information from your account, which may include Customer Data, to that AI Integration in response to requests made through it. AI Integrations currently provide read-only access to your own business records. If MyPlannery makes additional capabilities available, they will be described in the Services and are subject to these Terms and any applicable Feature Terms. Information transmitted to an AI Integration is no longer within MyPlannery’s control.
You represent and warrant that you have provided all notices and obtained all consents required by law to transmit Customer Data to the AI Integration you enable, that your privacy notice accurately describes that transmission, and that doing so does not violate any agreement between you and your customers or any applicable law, including data protection and cross-border transfer requirements.
AI Integrations are operated by third parties. MyPlannery does not review, endorse, certify, vet, or monitor any AI Integration or its provider and makes no representation or warranty regarding their security, availability, accuracy, retention, or data handling practices, including whether a provider uses transmitted information to train its models. Your use of an AI Integration is governed by that provider’s own terms and policies, and any dispute regarding an AI Integration is between you and that provider. MyPlannery is not liable for any act, omission, outage, security incident, data loss, unauthorized access, or data use by an AI Integration or its provider.
You are responsible for securing the credentials, tokens, devices, and third-party accounts used with any AI Integration; for all requests made through an AI Integration connected to your account, whether made by you, your team members, or an automated agent; for any output generated by an AI Integration and any decision you make based on it; and for promptly disabling an AI Integration you no longer use or that you believe has been compromised. Requests made through an AI Integration connected to your account are treated as actions taken by you.
Output generated by an AI Integration is produced by a third-party system and is subject to the same limitations described in the AI Features and AI Outputs section. It may be inaccurate, incomplete, or outdated, and MyPlannery does not warrant that information retrieved through an AI Integration is accurate, complete, or current.
You agree not to use an AI Integration or any programmatic interface to the Services to exceed applicable rate or usage limits; to extract, replicate, or export data in bulk beyond your ordinary business use of the Services; to provide access to any third party other than your authorized users; to resell or offer access as part of another product or service; or to develop, train, or improve a product, model, or service that competes with the Services.
MyPlannery may set, change, or enforce rate limits, usage limits, and scope restrictions on AI Integrations, and may throttle, suspend, restrict, or terminate access for any AI Integration or provider, with or without prior notice, including where MyPlannery reasonably believes that use threatens the security, integrity, availability, or performance of the Services, violates these Terms or applicable law, or is required by a third-party provider. AI Integration availability is not guaranteed, and MyPlannery may modify or discontinue it at any time.
You represent and warrant that you have provided all notices and obtained all consents required by law for MyPlannery and its service providers to collect, process, store, analyze, and share Customer Data as necessary to provide the IQ Features you enable, including processing by automated systems and artificial intelligence, the model training described below, and, where you enable referrals or other sharing functionality, disclosure to the recipients designated through your Configurations. Your privacy notice to your customers must accurately describe your use of the Services for these purposes.
MyPlannery may use third-party service providers, including artificial intelligence model providers, to process your content and Customer Data on MyPlannery’s behalf in providing the Services, subject to confidentiality and data protection obligations.
Subject to the Connected Accounts section, MyPlannery may use your content and Customer Data to develop, train, and improve MyPlannery’s own proprietary artificial intelligence and machine learning models, which MyPlannery uses to provide and improve the Services. MyPlannery does not sell, license, or otherwise provide your content or Customer Data to third parties for the purpose of training their models, and does not permit its third-party artificial intelligence providers to use your content or Customer Data to train their generally available models. These commitments do not apply to information you direct MyPlannery to transmit to an AI Integration you enable. That information is handled under the AI Integration provider’s own practices, which may include using it to train or improve their models, and MyPlannery does not control and is not responsible for those practices.
You agree not to submit, and not to configure IQ Features to collect, government identification numbers, full payment card or bank account numbers, health information, or other sensitive personal information, except through fields or features the Services expressly designate for that purpose.
MyPlannery may combine and de-identify data from across the Services, including pricing, booking, inquiry, and transaction data, to create aggregated benchmarks, statistics, and industry insights. MyPlannery may use these aggregated insights within the Services and may publish or share them externally, provided that they do not identify you, your customers, or any individual, and do not disclose your individual pricing.
MyPlannery may make IQ Features or functionality available on a beta, preview, pilot, or early access basis. These features are provided "as is," may be incomplete or contain errors, may be changed or discontinued at any time without notice, and may be subject to usage limits. MyPlannery may begin charging for a beta or preview feature after providing notice. To the maximum extent permitted by law, MyPlannery has no liability of any kind arising from your use of a beta, preview, pilot, or early access feature, and those features are excluded from any commitment, service level, or warranty.
MyPlannery maintains records of Automated Actions and may make activity logs available to you within the Services. MyPlannery may monitor the use of IQ Features for security, abuse prevention, compliance, and service quality.
MyPlannery may throttle, pause, limit, or disable any IQ Feature or Automated Action, with or without prior notice, if MyPlannery reasonably believes that your use violates these Terms or applicable law; generates spam complaints, bounce rates, or opt-out rates above acceptable levels; threatens the security, integrity, or sender reputation of the Services or other users; is required by a payment processor, bank, card network, Connected Account provider, or other third-party provider; or involves unpaid fees.
In addition to the other restrictions in these Terms, you agree not to use IQ Features to:
PrecisionIQ is an optional pricing tool. When you enable PrecisionIQ on an invoice, PrecisionIQ calculates a price for that invoice designed so that, after the applicable processing fees and the PrecisionIQ Fee, your net deposit approximates the amount you set as your target (your "Target Amount"). The price calculated by PrecisionIQ, including any rounding you select, is your regular price for that invoice (the "Card Price"). Your customer may receive a discount from the Card Price when paying by ACH bank transfer or by another payment method the Services designate as eligible for a discount (a "Payment Method Discount"). You, and not MyPlannery, set your prices, and you are responsible for the prices you charge.
PrecisionIQ is structured as a discount program. PrecisionIQ does not add a surcharge, convenience fee, service fee, or any other fee to your customers’ payments. When PrecisionIQ is enabled on an invoice, you agree to:
MyPlannery displays the Payment Method Discount to your customers at checkout in a form MyPlannery determines. You will not alter, obscure, or contradict that disclosure.
MyPlannery makes no representation or warranty that PrecisionIQ, or your use of it, complies with the laws, card network rules, or processor requirements applicable to you, and MyPlannery does not provide legal advice regarding pricing, discounts, or surcharging. You are responsible for determining whether PrecisionIQ is appropriate for your business and jurisdiction and for obtaining your own legal advice. You are solely responsible for your prices and price disclosures to your customers.
For each payment processed through the Services on an invoice on which PrecisionIQ is enabled, including any tip added to that invoice, MyPlannery charges a fee equal to 0.50% (50 basis points) of the payment amount (the "PrecisionIQ Fee"). The PrecisionIQ Fee applies to both card and ACH payments and is in addition to the base processing fees that apply to that payment under your pricing. Tips collected through GrowthIQ are not subject to the PrecisionIQ Fee. The PrecisionIQ Fee may be deducted from the payment at the time of the transaction or, if not collected at that time, recovered using the same sources and methods that apply to Recoverable Costs under these Terms. The PrecisionIQ Fee does not currently apply to payments you record as received outside the Services, such as cash or check. MyPlannery reserves the right to apply the PrecisionIQ Fee to those payments in the future by providing at least 30 days’ notice, and any such change will apply only to invoices on which PrecisionIQ is enabled after the change takes effect.
The PrecisionIQ Fee rate in effect when you enable PrecisionIQ on an invoice applies to all payments on that invoice, even if MyPlannery later changes the PrecisionIQ Fee rate. Notwithstanding any other provision of these Terms, a change to the PrecisionIQ Fee rate applies only to invoices on which PrecisionIQ is enabled after the change takes effect, and MyPlannery will provide at least 30 days’ notice of any increase. Changes to base processing fees are governed by your pricing terms and may affect your net deposit as described below.
You may choose to have PrecisionIQ calculate exact prices or round prices up to the increments offered in your settings. Rounding is always applied upward, so a rounded price may result in a net deposit higher than your Target Amount. The rounding selection in effect when you enable PrecisionIQ on an invoice applies to that invoice.
PrecisionIQ calculations are based on the processing rates, PrecisionIQ Fee rate, tax rates, and other information in effect or entered at the time of the calculation. MyPlannery does not guarantee that your net deposit will equal or exceed your Target Amount. Your actual net deposit may differ because of, among other things, changes to processing rates; card type, international card, or currency conversion fees; partial payments or payments made across multiple payment methods; discounts, credits, or adjustments applied after the Card Price is calculated; tax rates or settings you enter; refunds, disputes, chargebacks, and returns; or inaccurate information provided to the Services.
The balance of an invoice on which PrecisionIQ is enabled is stated at the Card Price. When your customer pays with a method eligible for a Payment Method Discount, the invoice is credited with the amount paid plus the corresponding Payment Method Discount (a "Discount Credit"). Your customer may pay an invoice using more than one payment method, and each payment is credited according to the payment method actually used.
Refunds on invoices on which PrecisionIQ is enabled are calculated in proportion to the amount actually paid, and the payment method actually used, for the portion being refunded. If a payment made with a method eligible for a Payment Method Discount is returned, reversed, or charged back, the related Discount Credit is also reversed and the invoice balance is restored accordingly. PrecisionIQ Fees are non-refundable as described in the Disputes, Chargebacks, and Returns section of these Terms. You remain responsible for refunding your customer any amount required by law or by your agreement with your customer.
PrecisionIQ must be enabled manually on each invoice. You may disable PrecisionIQ on an invoice only while the invoice is in draft status, in which case the prices in effect before PrecisionIQ was enabled are restored. After an invoice is sent, PrecisionIQ remains in effect for that invoice, and any edits the Services permit are calculated using the PrecisionIQ Fee rate stored when PrecisionIQ was enabled. Enabling or disabling PrecisionIQ does not affect invoices that have already been sent.
When you enable PrecisionIQ on an invoice, MyPlannery records the date and time, the version of these PrecisionIQ terms and any Feature Terms you accepted, the PrecisionIQ Fee rate, and your rounding selection. These records determine the terms and rates that apply to that invoice.
You are solely responsible for determining whether and how taxes apply to your services, the Card Price, and any Payment Method Discount, including whether tax should be calculated before or after a Payment Method Discount is applied. PrecisionIQ calculates taxes using the tax rates and settings you provide. Reports, exports, and accounting integrations that reflect Card Prices, Discount Credits, and fees are provided for convenience, and you are responsible for your accounting and tax treatment of those amounts.
InboundIQ allows you to receive and manage inquiries through forms, email, and other channels. You are responsible for the forms, questions, and custom fields you use, and for providing any notices and obtaining any consents required by law at the point of collection, including notice of automated follow-up and of any referral or sharing of inquiry information you enable.
InboundIQ may categorize, flag, or prioritize inquiries, such as by indicating whether an inquiry appears to be a fit or shows high intent, based on the criteria you configure and the information submitted. Qualification results are tools to help you organize inquiries. They are not decisions by MyPlannery, and they may be inaccurate or incomplete. You are responsible for deciding whether and how to respond to, accept, or decline any inquiry.
Automated responses, follow-up sequences, and questionnaires sent through InboundIQ are subject to the Automated Communications section of these Terms. MyPlannery may stop or pause a follow-up sequence when a recipient replies or opts out, and may limit the number and frequency of follow-ups.
Calendar conflict and availability checks rely on the accuracy and completeness of your Connected Accounts and the information in the Services. MyPlannery does not guarantee that availability results are accurate or that double bookings will be prevented. You are responsible for confirming your availability before making any commitment to a customer.
If you enable referrals, InboundIQ may share an inquirer’s information with the referral recipients you choose through your Configurations. You represent that you have the right, and any consent required by law, to share that information. Referral recipients are independent third parties, and MyPlannery does not endorse, vet, or guarantee them or their services. You are responsible for any referral fees, commissions, or other compensation arrangements between you and referral recipients, and for any disclosure of those arrangements required by law.
InboundIQ may assign inquiries to team members and display performance metrics, such as assignment counts, stalled inquiries, conversion rates, and average deal size. These metrics depend on how your team uses the Services and may not reflect individual performance. They are not intended to be the sole basis for any employment, compensation, or contractor decision, and you are responsible for complying with the employment and privacy laws that apply to your use of them.
InboundIQ may compare an inquirer’s stated budget with your pricing and suggest talking points or responses. This guidance is informational, and you are responsible for the accuracy of any statements you make to prospects about your pricing or about market pricing.
GrowthIQ allows you to send customers requests for feedback, online reviews, tips, and referrals. GrowthIQ requests are sent only when you initiate them and only to customers who meet the eligibility requirements set by the Services. These communications are subject to the Automated Communications section of these Terms.
You are responsible for complying with all laws, regulations, and guides that apply to consumer reviews, testimonials, and endorsements, including those issued by the Federal Trade Commission, and with the policies of any third-party review platform. Without limiting the foregoing, you agree not to:
Tips collected through GrowthIQ are payments from your customers to you. They are subject to applicable processing fees but are not subject to the PrecisionIQ Fee. MyPlannery does not distribute tips to your staff or contractors. You are solely responsible for any allocation or distribution of tips and for compliance with wage, hour, tip, and tax reporting laws.
You determine the terms of any referral program you offer through GrowthIQ, including eligibility and rewards. You are solely responsible for funding and fulfilling referral rewards, for the accuracy of your referral program terms, and for compliance with the laws that apply to your program, including any tax reporting obligations. MyPlannery is not a party to your referral program.
MarginIQ provides estimates of your revenue, costs, and take-home profit based on information you enter, such as your quoted prices and cost of delivery, and on transaction data within the Services. MarginIQ results are estimates for internal planning purposes only. They are not prepared in accordance with generally accepted accounting principles, are not audited or reviewed, and are not tax, accounting, or financial advice. You are responsible for the accuracy of the information you enter and for verifying MarginIQ results before relying on them for pricing, tax filings, financial statements, lending, or any other purpose. Where MarginIQ data is synced to accounting software, you are responsible for reviewing the synced entries.
MyPlannery may integrate with third-party services to enhance platform functionality. MyPlannery does not own or control third-party services and disclaims liability for any issues associated with them. Your use of third-party services is subject to their respective terms. Third-party services include Connected Accounts, AI Integrations, and the artificial intelligence model providers used to deliver IQ Features. Changes by third parties to their products, interfaces, access policies, or pricing may affect the availability or functionality of IQ Features, and MyPlannery is not liable for those changes.
For questions or concerns about these Terms, contact hello@myplannery.com.
Your use of the Services is subject to our Privacy Policy, which explains how we collect, use, and protect your data, including data processed by IQ Features and data obtained from Connected Accounts.
MyPlannery retains all rights to its proprietary software, trademarks, and intellectual property. Users may not copy, distribute, reverse engineer, or create derivative works without authorization.
MyPlannery responds to notices of alleged copyright infringement under the Digital Millennium Copyright Act. If you believe content on the Services infringes your copyright, send a notice containing the information required by 17 U.S.C. 512(c)(3) to MyPlannery’s designated agent at [DMCA agent name and address], [dmca@myplannery.com]. MyPlannery may remove or disable access to allegedly infringing content and may terminate the accounts of repeat infringers.
These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply. For any dispute not subject to the Arbitration Agreement below, you and MyPlannery consent to the exclusive jurisdiction and venue of the state and federal courts located in Fulton County, Georgia, and each party waives any objection to that venue.
MyPlannery may suspend or terminate your account for violations of these Terms or prolonged inactivity defined as 12 months of no activity. MyPlannery may also suspend or restrict your account immediately, with or without notice, where MyPlannery reasonably believes doing so is necessary to protect the security or integrity of the Services, to comply with law or the requirements of a payment processor, bank, or card network, or to prevent fraud, loss, or harm to MyPlannery, other users, or third parties. MyPlannery may terminate these Terms or discontinue the Services for convenience on 30 days’ notice. You may terminate at any time by closing your account.
Termination does not relieve you of outstanding obligations, including fees, Recoverable Costs, negative balances, disputes, chargebacks, compliance obligations, or other financial responsibilities. All recovery rights survive termination.
When your account is suspended or terminated, Automated Actions will stop, including scheduled communications and follow-ups, and MyPlannery may revoke its access to your Connected Accounts. Access through any AI Integration will also stop. You are responsible for any communications or obligations to your customers affected by that stoppage. Invoices on which PrecisionIQ was enabled remain subject to the PrecisionIQ terms, including the PrecisionIQ Fee, for any payments processed through the Services after suspension or termination.
For 30 days after termination, and provided your account is in good standing and no amounts are outstanding, MyPlannery will make commercially reasonable efforts to allow you to export your data using the export tools available in the Services. After that period, MyPlannery may delete your data in accordance with its retention practices and the Privacy Policy, and has no obligation to retain it. MyPlannery may retain data where required by law or where necessary to resolve disputes, recover amounts owed, or comply with the requirements of a payment processor, bank, or card network.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYPLANNERY AND ITS SUPPLIERS AND LICENSORS DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE.
Without limiting the foregoing, MyPlannery does not warrant that the Services will be uninterrupted, secure, timely, error-free, or free of harmful components, that any defect will be corrected, or that the Services will meet your requirements or produce any particular result. MyPlannery makes no warranty that IQ Features, AI Outputs, qualification results, availability checks, calculated prices, net deposit estimates, benchmarks, profitability estimates, or information retrieved through an AI Integration will be accurate, complete, current, uninterrupted, or suitable for your purposes. No advice or information, whether oral or written, obtained from MyPlannery or through the Services creates any warranty not expressly stated in these Terms.
Some jurisdictions do not allow the exclusion of certain warranties. To the extent an exclusion is not permitted, it does not apply to you, and any implied warranty is limited in duration to the shortest period permitted by applicable law.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYPLANNERY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, OR ANTICIPATED SAVINGS, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, AND WHETHER OR NOT MYPLANNERY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
MYPLANNERY’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID TO MYPLANNERY IN THE THREE MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Without limiting the foregoing, MyPlannery is not liable for lost bookings, lost or missed inquiries, undelivered or delayed communications, inaccurate qualification or availability results, differences between your Target Amount and your actual net deposit, the content or consequences of AI Outputs or Automated Actions, the acts or omissions of your customers, or the acts, omissions, outages, security incidents, or data practices of any third party, including payment processors, banks, card networks, Connected Account providers, AI Integrations and their providers, and referral recipients.
These limitations apply even if a limited remedy fails of its essential purpose, and they reflect an agreed allocation of risk that is a fundamental part of the basis of the bargain between you and MyPlannery. Some jurisdictions do not allow certain limitations of liability, and to the extent a limitation is not permitted, it does not apply to you.
Any claim arising out of or relating to these Terms or the Services must be brought within one year after the claim accrues, or it is permanently barred, except where a longer period is required by applicable law.
You agree to indemnify, defend, and hold harmless MyPlannery and its officers, directors, employees, agents, suppliers, and licensors from any claims, damages, losses, liabilities, or expenses, including reasonable attorneys’ fees, arising out of your use of the Services, your customers’ use of the Services, your breach of these Terms or of any representation or warranty you make in them, disputes, chargebacks, regulatory violations, communications sent through the Services on your behalf, Automated Actions taken under your Configurations or approvals, your qualification criteria, referrals, and review or referral programs, your pricing and price disclosures, your collection and use of Customer Data, your enablement and use of any AI Integration and the transmission of Customer Data to it, or Recoverable Costs associated with your account.
MyPlannery will give you written notice of any claim for which it seeks indemnification, though a delay in notice reduces your obligations only to the extent you are materially prejudiced. MyPlannery may participate in the defense with counsel of its own choosing at its own expense, and may assume control of the defense if you fail to defend diligently. You will not settle any claim in a way that imposes any obligation or liability on MyPlannery, requires any admission by MyPlannery, or affects MyPlannery’s rights, without MyPlannery’s prior written consent.
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES DISPUTES TO BE RESOLVED BY INDIVIDUAL BINDING ARBITRATION AND WAIVES YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.
Before initiating arbitration, you and MyPlannery agree to try to resolve the dispute informally. The party raising the dispute will send a written notice to the other describing the dispute, the relief sought, and the basis for it. Notice to MyPlannery goes to hello@myplannery.com. The parties will negotiate in good faith for 60 days after the notice is received. This process is a condition precedent to initiating arbitration, and the limitations period is tolled during it. Either party may seek to enjoin the filing of an arbitration brought without completing this process.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Services, including their formation, interpretation, breach, enforcement, or termination, and including claims that arose before these Terms took effect, will be resolved by final and binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, rather than in court. The Federal Arbitration Act governs the interpretation and enforcement of this section. The arbitration will be conducted by a single arbitrator, seated in Fulton County, Georgia, and may proceed by written submissions or videoconference where the arbitrator permits. The arbitrator’s award may be entered as a judgment in any court of competent jurisdiction.
The arbitrator has exclusive authority to resolve any dispute about the interpretation, applicability, enforceability, scope, or formation of this Arbitration Agreement, including any claim that it is void or voidable. The sole exception is that a court, and not an arbitrator, decides any dispute about the enforceability, validity, or scope of the Class and Representative Action Waiver below.
You and MyPlannery each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate the claims of more than one person and may not preside over any form of class or representative proceeding, and may award relief only to the individual party seeking relief and only to the extent necessary to provide relief warranted by that party’s individual claim. If this waiver is found unenforceable as to any claim or request for relief, then this entire Arbitration Agreement is null and void as to that claim or request for relief, which will be severed and brought in a court of competent jurisdiction, and the remainder of this Arbitration Agreement will continue to apply to all other claims.
If 25 or more demands for arbitration raising substantially similar claims are filed against MyPlannery by or with the assistance of the same law firm or coordinated group of counsel within a 90-day period, the parties agree that the demands will be administered in sequential batches of no more than 50 at a time. Each batch will be treated as a single consolidated arbitration with one arbitrator, one filing fee per batch, and one set of administrative fees. Counsel for the claimants and MyPlannery will each select an equal number of demands per batch. No demand may proceed outside this process until its batch has been adjudicated or resolved, and the limitations period is tolled for demands awaiting a batch. Either party may seek a court order enforcing this provision. This provision is intended to promote efficient resolution and applies whether or not the applicable arbitration rules provide for batching.
Either party may bring an individual claim in small claims court if it qualifies. Either party may also seek injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual property, confidential information, or the security or integrity of the Services, without first completing informal resolution or arbitration. Nothing in this section prevents either party from reporting a matter to a government agency.
You may opt out of this Arbitration Agreement by sending written notice to hello@myplannery.com within 30 days after you first accept these Terms or any version of them containing an arbitration agreement. The notice must include your name, the email address on your account, and a clear statement that you are opting out of arbitration. Opting out does not affect any other provision of these Terms. If you do not opt out within that period, you are bound by this Arbitration Agreement, and later updates to these Terms do not create a new opt-out period unless the update materially changes this section.
This Arbitration Agreement survives termination of these Terms and closure of your account.
If for any reason a dispute proceeds in court rather than arbitration, you and MyPlannery each knowingly and irrevocably waive any right to trial by jury and any right to participate in a class, collective, consolidated, or representative action.
These Terms, together with any Feature Terms, the Privacy Policy, and any order form or pricing terms you accept, are the entire agreement between you and MyPlannery regarding the Services and supersede all prior or contemporaneous understandings, whether written or oral. Any additional or conflicting terms in a purchase order or similar document you issue are rejected and have no effect.
If any provision of these Terms is held invalid, illegal, or unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed, and the remaining provisions will remain in full force and effect. The Class and Representative Action Waiver is governed by its own terms and is not subject to this section.
MyPlannery’s failure to enforce any provision of these Terms is not a waiver of that provision or of any other right. A waiver is effective only if in writing and signed by an authorized representative of MyPlannery.
You may not assign or transfer these Terms or any rights under them, by operation of law or otherwise, without MyPlannery’s prior written consent, and any attempted assignment without consent is void. MyPlannery may assign these Terms without restriction, including in connection with a merger, acquisition, reorganization, or sale of assets. These Terms bind and benefit the parties and their permitted successors and assigns.
MyPlannery is not liable for any delay or failure to perform caused by circumstances beyond its reasonable control, including acts of God, natural disasters, epidemics, war, terrorism, civil unrest, labor disputes, government action, changes in law, failures or outages of the internet, telecommunications, hosting, payment processing, or other third-party services, and cyberattacks.
MyPlannery may give you notice by email to the address on your account, by posting on the Site, or through the Services, and notice is effective when sent or posted. You are responsible for keeping your email address current. You must send notices to MyPlannery at hello@myplannery.com, except where these Terms specify a different address.
These Terms do not create any third-party beneficiary rights. Your customers, team members, referral recipients, and other third parties have no right to enforce these Terms against MyPlannery.
You and MyPlannery are independent contractors. These Terms do not create a partnership, joint venture, franchise, employment, or agency relationship between the parties.
The following sections survive termination or expiration of these Terms: Platform Cost Recovery, Disputes, Chargebacks, and Returns, User Content, Feedback, Model Training, Intellectual Property, Governing Law, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Arbitration Agreement, and General Provisions, together with any other provision that by its nature should survive.
Headings are for convenience only and do not affect interpretation. "Including" means "including without limitation." These Terms will not be construed against either party as the drafter.
Privacy Policy
Welcome to MyPlannery!
This Privacy Policy describes how MyPlannery, Inc. ("Plannery," "we," "us," or "our") handles personal information collected through our website, mobile applications, and related services (collectively, the "Services"). By using our Services, you agree to the collection, use, and disclosure of your information as outlined in this policy.
This policy also describes how we handle information processed through the MyPlannery IQ Suite. In this policy, “Merchants” means businesses that use our Services to manage their events, clients, and payments, and “IQ Features” means the features of the MyPlannery IQ Suite, which use automation and, in some cases, artificial intelligence to help Merchants price their services, manage inquiries, communicate with clients, analyze profitability, and grow their businesses.
This policy applies to Merchants and their team members, to visitors to our website, and to individuals who interact with Merchants through our Services, such as by submitting an inquiry, receiving a proposal, contract, or invoice, making a payment, or responding to a feedback, review, tip, or referral request (“Merchant Customers”).
When we process information about Merchant Customers to provide the Services to a Merchant, we generally do so on behalf of that Merchant, and the Merchant’s own privacy notice also applies. If you are a Merchant Customer and want to access, correct, or delete information a Merchant holds about you, we recommend contacting that Merchant directly, and we will assist Merchants in responding to those requests. We also use certain information about Merchant Customers for our own limited purposes described in this policy, such as training our models, creating de-identified insights, preventing fraud, and complying with law.
Personal information you may provide through the Services includes:
When you use our Services, we may automatically collect information such as:
If a Merchant connects a third-party account, such as an email, calendar, or accounting account (a “Connected Account”), we access information in that account to the extent needed to provide the features the Merchant enables. This may include reading email messages to identify and import inquiries, sending emails on the Merchant’s behalf, checking calendar availability, creating calendar entries, and syncing accounting records. Merchants can disconnect a Connected Account at any time.
We may obtain information from third parties such as:
We use your personal information to:
We may share your information with:
If a Merchant connects a Google account, we access Google user data, such as Gmail messages and Google Calendar information, only to provide and improve the user-facing features the Merchant enables, such as importing inquiries, sending emails on the Merchant’s behalf, and checking availability.
Our use and transfer of information received from Google APIs to any other app will adhere to the Google API Services User Data Policy, including the Limited Use requirements. In particular, we do not:
We share Google user data with service providers, including artificial intelligence providers, only as necessary to provide or improve the user-facing features the Merchant enables, and only with providers that do not use it to train or improve their own models. Where we use a provider’s infrastructure to build or operate a model tailored exclusively to a Merchant’s own account, that model is ours, is used only to provide features to that Merchant, and is not used for any other Merchant or for our general-purpose models, and the provider does not use the data for its own purposes. When a Merchant disconnects a Google account, we stop accessing that account and delete Google user data obtained from it within 90 days, except where retention is required by law or where the Merchant has saved the information as a record in the Services, such as an imported inquiry, which remains subject to the restrictions in this section.
You can update or correct your information through your account settings or by contacting us.
You may request access to the personal information we hold about you, ask us to correct it, or ask us to delete it, regardless of where you live. Residents of California, Virginia, Colorado, and other states with comprehensive privacy laws may have additional rights, including the right to opt out of the sale or sharing of personal information, to limit the use of sensitive personal information, and to opt out of profiling that produces legal or similarly significant effects. We do not discriminate against you for exercising any of these rights. To exercise any of them, contact hello@myplannery.com.
We may require you to verify your identity before processing requests. If your request concerns information we process on behalf of a Merchant, we may refer your request to that Merchant or assist that Merchant in responding.
You can opt out of promotional emails by following the unsubscribe link in the email or contacting us directly.
If you receive an automated communication sent through the Services on behalf of a Merchant, you can opt out by using the unsubscribe link or following the instructions in that communication, or by contacting the Merchant directly.
Merchants can disconnect Connected Accounts and disable IQ Features at any time in their account settings. Google account access can also be revoked through your Google Account settings. Disconnecting an account or disabling a feature stops future access and automated actions but does not by itself delete information already collected, which is handled as described in the Data Retention section.
IQ Features may categorize or prioritize inquiries using criteria that Merchants configure. These categorizations help Merchants organize inquiries and do not, on their own, produce legal or similarly significant effects. Merchants decide whether and how to respond to any inquiry.
You can manage cookies through your browser settings and opt out of interest-based advertising via industry tools such as the Digital Advertising Alliance (DAA).
We use cookies to enhance your experience. Essential cookies are required for the functioning of our Services. You can manage your cookie preferences through our Cookie Management Tool.
We use commercially reasonable measures to protect your information, including encryption and secure storage. Our payment processor is PCI DSS compliant. We limit access to Connected Account data and information processed through IQ Features to personnel and service providers who need it to provide the Services. No method of transmission over the Internet is completely secure, and you are responsible for keeping your account credentials safe. If you believe your account has been compromised, contact us immediately.
We retain personal information for as long as necessary to provide our Services, comply with legal obligations, resolve disputes, and enforce our agreements. Certain payment and transaction data may be retained longer as required by law, card network rules, or regulatory obligations. Marketing data will be retained for 7 years unless you opt out.
Information about Merchant Customers is retained based on the Merchant’s use of the Services and the retention needs described above. We retain records of automated actions and PrecisionIQ activation records for as long as needed to support the related invoices, payments, disputes, and legal obligations. Google user data is retained as described in the Google User Data section.
Information used to train our models before it is deleted may continue to influence those models after deletion. We may retain de-identified and aggregated information indefinitely. We maintain de-identified information in de-identified form and do not attempt to re-identify it, except as permitted by law.
Plannery does not knowingly collect information from individuals under the age of 13 and complies with the Children’s Online Privacy Protection Act (COPPA). If we learn that we have collected such information, we will delete it promptly. If you believe we have collected data from a child under 13, please contact us at hello@myplannery.com. Merchants may not use the Services to knowingly collect information from children under 13.
The Services are intended for use in the United States and are not directed to individuals outside the United States. If you access our Services outside the United States, your information may be transferred to and processed in the United States with different data protection laws.
If we make significant changes to this policy, we will notify you by email or post an update on our website at least 30 days before the changes take effect.
For questions or concerns about this Privacy Policy, contact us at hello@myplannery.com
This Refund Policy explains how refunds are handled for:
This policy forms part of the Terms of Service and applies to all U.S. users. The Services are offered in the United States. Capitalized terms not defined here have the meanings given in the Terms of Service.
This policy is incorporated into and governed by the Terms of Service, including the sections covering Disputes, Chargebacks, and Returns; Platform Cost Recovery, Authorization to Debit, and Negative Balances; Limitation of Liability; Disclaimer of Warranties; and the Arbitration Agreement. If this policy conflicts with the Terms of Service, the Terms of Service control, except where this policy expressly states otherwise.
Nothing in this policy limits any right you have that cannot be waived under applicable law.
Certain features and services incur usage-based fees, including payment processing, instant payouts, account updater, PrecisionIQ and other IQ Features, automated communications, tax document services, and other optional enhancements.
PrecisionIQ Fees are non-refundable. The full PrecisionIQ terms, including how balances and Discount Credits are calculated, are set out in the PrecisionIQ section of the Terms of Service.
When a refund is initiated through MyPlannery, we will process the refund and:
If a Merchant does not have sufficient funds available at the time a refund is processed, the refund may create a negative balance on the Merchant’s account, which is handled as described in the Platform Cost Recovery section of the Terms of Service. MyPlannery is not obligated to advance funds to cover a refund.
If you paid a Merchant through MyPlannery and believe you are owed a refund, please contact the Merchant directly. The Merchant, and not MyPlannery, set the prices, provided the goods or services, and decides whether a refund is owed. MyPlannery processes payments and refunds at the Merchant’s direction and cannot issue a refund on a Merchant’s behalf without that Merchant’s instruction. If you believe a payment was unauthorized, you should also contact your bank or card issuer.
A chargeback, dispute, or ACH return is not a refund. Those are initiated by a Client through their bank or card issuer and are governed by card network and NACHA rules and by the Disputes, Chargebacks, and Returns section of the Terms of Service. Merchants are responsible for all chargebacks, disputes, ACH returns, reversals, penalties, and network fines arising from their Clients’ payments, together with the associated fees, which are non-refundable. Issuing a refund does not guarantee that a chargeback will be withdrawn or resolved in the Merchant’s favor.
If a Merchant believes they were billed incorrectly (for example, duplicate charge or wrong plan rate), they must notify MyPlannery at hello@myplannery.com within 30 days of the charge.
This policy is governed by the laws of the State of Delaware, without regard to conflict of laws principles, and is subject to applicable U.S. payment network and NACHA rules, including those of Visa, Mastercard, American Express, and Discover. Disputes arising out of or relating to this policy are subject to the Arbitration Agreement in the Terms of Service.
MyPlannery may update this policy to reflect regulatory or network changes. Revised versions will be posted on www.myplannery.com and become effective upon posting. Updates required to comply with applicable law, card network rules, NACHA rules, or the requirements of a payment processor or banking partner take effect immediately upon posting. For other material changes, MyPlannery will provide notice as described in the Acceptance of Terms section of the Terms of Service. Your continued use of the Services after an update takes effect constitutes your acceptance of the updated policy.
